Our Core Principles

Here at Chairish, Inc. and its affiliates, including DECASO and Dering Hall, (referred to through this Privacy Policy as "Chairish," "we," "us," and "our"), we want you to be in control of your information and get the most from it. While this privacy policy is specifically about how we collect and use your information, we have the following core principles by which we will abide. Even as the details in the rest of this privacy policy may change, these core principles will remain constant.

  • Your information on the Chairish's Services belongs to you.
  • We will help you to control your information.
  • We will tell you what we do with your information.
  • We will never spam you or abuse your information.

Remember that your use of Chairish's Services is at all times subject to the Terms of Service, which incorporates this Privacy Policy. Any terms we use in this Policy without defining them have the definitions given to them in the Terms of Service.

What types of information are we talking about?

  1. Information you provide to us; and
  2. Information that we collect when you use our website and Services (Services are defined in our Terms of Service).

Information You Provide to Us

When you register with Chairish, you provide us with information to register and set up an account, including email, name, billing and credit card information, contact and other business-related information if you are buying or selling items ("Account Data"). We use this information to provide you the Services and send you Services related notices (including any notices required by law).

We also use your Account Data and data related to your use of the Services to inform you about the Services (such as newsletters, updates to features of the Services), and special offers and promotions from Chairish or our partners.

If you correspond with Chairish, we may retain the content of your messages, your email address and our responses.

If you invite a third party to follow your Chairish gallery through our Services, we will use that party's email address for the sole purpose of sending your invitation. You must have permission from other individuals before you share their contact information with us. If you do not have permission to share an individual's information with us, then you must not submit any such information to Chairish.

You can edit or delete your Chairish account information, including your marketing preferences, at any time by going to https://www.chairish.com/account/update, https://www.decaso.com/account/update, and https://deringhall.com/account/personal. Please note you cannot opt out of certain Services related notices. New marketing categories may be added to the marketing preferences from time to time.

Some information may remain in our records after your deletion of such information from your account. We may use any aggregated data derived from your personal information after you update or delete it, but not in a manner that would identify you personally.

Information that We Collect When You Use the Website and Services

When you use the Chairish websites and Services (such as this one), we and our partners (including third parties such as Google) use cookies, pixel tags, "web beacons" (electronic images placed in the code of a web page that monitor online traffic patterns) or similar technologies. Our partners may collect and provide us certain aggregate information about your visit to the Services, including your IP address. This aggregated information, which we do not tie to your personal information, helps us improve your experience; deliver advertising and content targeted to your interests on our Services and other websites; analyze products and services, and the use of those products and services; and to better understand your online activity. While our Services may not operate properly without these technologies, you can set your web browser to refuse all cookies.

Through cookies we place on your browser or device, we may collect information about your online activity after you leave our Services. Just like any other usage information we collect, this information allows us to improve the Services and customize your online experience, and otherwise as described in this Privacy Policy. Your browser may offer you a "Do Not Track" option, which allows you to signal to operators of websites and web applications and services (including behavioral advertising services) that you do not wish such operators to track certain of your online activities over time and across different websites. Our Services do not support Do Not Track requests at this time, which means that we collect information about your online activity both while you are using the Services and after you leave our Services. Certain of our Services may allow you to choose to register with or log-on to our Services using third-party login credentials, such as your Facebook account information. If you are a Member of Chairish's Services, you may choose to include a link in your Chairish's storefront to your account on a third-party social media website, such as Facebook. If you are a Member of Chairish's Services and you log on to the Services using your third-party social media account credentials, you may post notifications regarding new products on your social media account, such as on your Facebook wall. If you choose to register and log-on to the Services using third-party social media account credentials, or if you include a link to your social media account in your storefront, we will collect certain registration information from your social media account, which includes your name and email address, and additional information that may be necessary to authenticate your access to the Services in the future. If you log-on to the Services using third-party social media account credentials, and you choose to "Follow" a Member of Chairish, you consent to Chairish posting a notification on your social media account, such as on your Facebook wall, that you are "following" that Member. You may opt-out of these social media posts at any time by emailing us at support@chairish.com or by changing your preferences on your account page.

How We Share Your Information

Personally Identifiable Information: Chairish will not rent or sell your personally identifiable information to others and will not share it with others, except as follows:

  • Chairish may disclose such information (a) if we are required to do so by law or subpoena, (b) to enforce our terms and policies; or (c) to exercise or protect the rights, property, or safety of Chairish, our Users or others.
  • Chairish may store information in physical locations outside the direct control of Chairish (for instance, on servers or databases co-located with hosting providers).
  • Chairish may share your information with other Users of Chairish to facilitate transactions between Users. For example, if you communicate with a Seller, to inquire about or to purchase an item through Chairish or otherwise, we may share your name and email address, with the Seller of such item, and in the case of a purchase, your payment and shipping information. Without express consent, Sellers should only contact Users and use their personal information for Chairish related communications and for completing the transaction for which the information was provided. Sellers should not use this information to distribute unsolicited commercial messages. Unless a User "follows" the Seller, or the User consents, Sellers should not add Users to their email lists.
  • If you send messages to other Users your name, username and the content of such messages will be available to such other Users, and if you publicly post any content on the Chairish website such content, your name and your username will be publicly available.
  • Certain of our Services may allow you to choose to be a "Follower" of any Seller on the Chairish Services by clicking on the "Follow" button while viewing any Seller's storefront. If you become a "Follower" of a Seller, your email address and other personal information that you have provided to Chairish may be provided to that designer in order to send you email notifications and other information regarding the Seller's business, including announcements, events and new products. By choosing to "Follow" a Seller, you consent to receiving email notifications regarding the Seller and to the sharing of your personal information, including your name and email address, with that Seller. Sellers are not agents of Chairish, and Chairish does not control the privacy practices of the Sellers. Chairish may also send you emails or other notices to notify you of developments regarding each of the Sellers that you follow. If you no longer wish to follow a Seller, you may click on the "Unfollow" button on your Chairish account page or on the Seller's storefront at any time. Chairish will attempt to honor "Unfollow" requests promptly, however, Chairish does not control the privacy practices of the Sellers or any other third party.
  • Chairish may share your information with trusted third party service providers that Chairish has contracted with to provide you the Services (for example, third party shipping services).
  • Chairish may share your information with trusted third party service providers that Chairish has contracted with to provide advertising services using information that our customers provide. If you prefer that Chairish not share your information with these third party service providers, you can opt out by emailing us at support@chairish.com.
  • Chairish may de-identify your personally identifiable information or aggregate information about how you use the Services with usage data from other Users. Chairish may share such de-identified or aggregate usage data with its partners (but not in a manner that would identify you as an individual person).
  • Chairish may transfer such information if Chairish is acquired as a business or if its assets are sold, as is typical when a business is acquired or merged.

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to contact us to prevent disclosure of Personal Information to third parties for such third parties' direct marketing purposes; in order to submit such a request, please contact us at support@chairish.com. California residents are entitled to ask us for a notice identifying the categories of Personal Information which we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties. How We Protect Your Information

Chairish employs well-established security measures to safeguard our systems and your information. However, we cannot control all the individuals and activities on the internet and elsewhere, and therefore cannot guarantee that such information will never be compromised.

Children's Privacy

Chairish's website and Services are not intended to be used by or directed at children under the age of 16. Chairish does not knowingly collect information of such children. If you are under the age of 16, you may not use the website or Services and you should not submit any information to us.

Links to External Servers and other Websites and Services

When you link to or interact with external servers, or other websites or services, our Privacy Policy no longer applies and you are subject to that website's or service's own rules and policies. Please read over those rules and policies so you understand how they treat your information.

Notification Procedures

It is our policy to provide notifications, whether such notifications are required by law or are for marketing or other business related purposes, to you via email notice, through posting of such notice on our web page, or by other reasonable means, as determined by Chairish in its sole discretion. We reserve the right to determine the form and means of providing notifications to you.

U.S. Based Service

Our center of operation is in the United States. Your data is held in the United States and transactions are processed in US Dollars on servers in the United States. As such, all data is held in accordance with United States laws and procedures which differ from those in other regions of the world, such as the European Union. By using our Services, you acknowledge that you understand and agree to these data policies. If you are a resident of the European Union ("EU"), United Kingdom, Lichtenstein, Norway, or Iceland, you may have additional rights under the EU General Data Protection Regulation (the "GDPR"). Changes to Our Privacy Policy

If we change our privacy policies and procedures, we will post those changes on our website to keep you aware of what information we collect, how we use it and under what circumstances we may disclose it. What Personal Data Do We Collect From You?

We collect Personal Data about you when you provide such information directly to us, when third parties such as our business partners or service providers provide us with Personal Data about you, or when Personal Data about you is automatically collected in connection with your use of our Services.

Information we collect directly from you: We receive Personal Data directly from you when you provide us with such Personal Data, including without limitation the following:

  • First and last name
  • Email address
  • Mailing address
  • Telephone number
  • Credit/debit card information
  • User content, for example, comments and posts you submit publically and photographs you upload to the Chairish website (which can include Personal Data if you include Personal Data in such content)

Information we receive from third party sources: Some third parties such as our business partners and service providers provide us with Personal Data about you, such as the following:

  • Information from our advertising partners: We receive information about you from some of our service providers who assist us with marketing or promotional services related to how you interact with our websites, applications, products, services, advertisements, or communications.
  • Account information for third party services: If you interact with a third party service when using our Services, such as if you use a third party service to log-in to our Services (e.g., Facebook Connect or Twitter OAuth), or if you share content from our Services through a third party social media service, the third party service will send us information about you such as information from your public profile. The information we receive will depend on the third party service's policies and your account settings with the third party service.

How Long Do We Retain Your Personal Data?

We retain Personal Data about you for as long as you have an account with us or as otherwise necessary to provide the Services. We also retain some information in a depersonalized or aggregated form but not in a way that would identify you personally.

What Security Measures Do We Use?

We seek to protect Personal Data using appropriate technical and organizational measures. For example, we encrypt any Personal Data you submit to us using secure socket layer (SSL) technology to provide for the secure transmission from your PC to our servers, we use industry-standard firewalls and other access control measures to restrict access to your Personal Data once it is stored on our servers, and we encrypt any Personal Data we send to or receive from third party service providers using SSL.

Personal Data of Children:

As noted above, we do not knowingly collect or solicit Personal Data from anyone under the age of 16. If you believe that a child under 16 may have provided us Personal Data, please contact us at support@chairish.com. We will delete such information as quickly as possible once we learn of it.

What Rights Do You Have Regarding Your Personal Data?

You have certain rights with respect to your Personal Data, including those set forth below. For more information about these rights, or to submit a request, please email support@chairish.com. Please note that in some circumstances, we may not be able to fully comply with your request, such as if it is frivolous or extremely impractical, if it jeopardizes the rights of others, or if it is not required by law. Even if we are not able to comply with your request, we will still respond to notify you of such a decision. In some cases, we may also need to you to provide us with additional information, which may include Personal Data, if necessary to verify your identity and the nature of your request.

  • Access: You can request more information about the Personal Data we hold about you and request a copy of such Personal Data.   • Rectification: If you believe that any Personal Data we are holding about you is incorrect or incomplete, you can request that we correct or supplement such data.   • Erasure: You can request that we erase some or all of your Personal Data from our systems.
  • Withdrawal of Consent: If we are processing your Personal Data based on your consent (as indicated at the time of collection of such data), you have the right to withdraw your consent at any time. Please note, however, that if you exercise this right, you may have to then provide express consent on a case-by-case basis for the use or disclosure of certain of your Personal Data, if such use or disclosure is necessary to enable you to utilize some or all of our Services.
  • Portability: You can ask for a copy of your Personal Data in a machine-readable format. You can also request that we transmit the data to another controller where technically feasible.

Transfers of Personal Data

The Services are hosted and operated in the United States ("U.S.") through Chairish and its service providers, and if you do not reside in the U.S., laws in the U.S. may differ from the laws where you reside. By using the Services, you acknowledge that any Personal Data about you, regardless of whether provided by you or obtained from a third party, is being provided to Chairish in the U.S. and will be hosted on U.S. servers, and you authorize Chairish to transfer, store, and process your information to and in the U.S., and possibly other countries.
